Misdiagnosis

Proper diagnosis and treatment is crucial for saving lives. When doctors misdiagnose a patient's condition, it can mean the difference between life and death.

Whether you experienced a misdiagnosis, a delayed diagnosis, or a failure to diagnose a medical condition, the attorneys of Zucker & Regev, P.C. are here to help.

Our Brooklyn medical malpractice lawyers stand with patients throughout New York, NY.

Misdiagnosis and Failure to Diagnose An Overview

Attorney Gary Zucker represents clients in medical malpractice cases in which a failure to diagnose cancer has substantially affected their chances of recovery. While cancer is a dangerous disease, there are many types that are easily curable if caught in the early stages. A doctor's failure to accurately read a mammogram, thoroughly remove abnormal growth during a colonoscopy, or follow up on results can delay treatment and allow cancer to progress to more dangerous stages.

The Dangers of Misdiagnosis Negligence That Can Cost Lives

Wrong Treatment

A doctor may misdiagnose a condition and recommend the wrong treatment. For example, a doctor may mistakenly diagnose a viral infection as a bacterial infection, and prescribe antibiotics rather than antiviral medication. Sometimes these mistakes result in unnecessary surgery.

Delayed Treatment

An initial misdiagnosis may result in a delay of proper treatment. Timing is crucial when treating any medical problem. Early detection tends to mean less invasive procedures and faster recovery. Misdiagnosing a problem may require later hospitalization if proper treatment isn't provided.

Lack of Treatment

In some misdiagnosis cases, a doctor completely fails to treat the patient's health issues. This allows a medical problem to progress and become worse without any professional attention. In these cases, patients may be ill or injured for years and not realize it until it's too late.

Failure to Diagnose Another Dangerous Medical Error

Failure to diagnose a medical condition is a facet of misdiagnosis cases. Rather than incorrectly diagnosing a medical condition, doctors do not diagnose any medical problem despite telltale signs and symptoms. This type of negligence can have tragic repercussions.

The Medical Condition Worsens

If a medical problem goes undiagnosed, treatment is not provided and health declines. What's more, a patient cannot modify behavior or adjust their lifestyle to manage the condition and prevent future harm. In the case of terminal illnesses, the lack of early detection and treatment makes the battle against the disease more difficult.

Need for Additional Medical Care

Catching a condition in its earliest stages typically means less invasive treatment. Failure to diagnose a condition means that patients may require additional and more invasive treatment later on. These procedures are often expensive, putting a financial burden on a household that can derail career and personal plans.

Heart Attack

According to the American Heart Association, someone in the United States suffers a heart attack every 40 seconds. Heart disease is the leading cause of death in America, which is why all doctors must be mindful of any warning signs of cardiovascular health issues. Treating high blood pressure and other risk factors of a heart attack can save a patient's life.

Strokes

Like heart attacks, the American Heart Association estimates someone in the United States suffers a stroke every 40 seconds. Approximately 1 in 19 deaths in America is the result of a stroke, making it the fifth leading cause of death in the country. Failure to diagnose and treat a stroke can prove fatal. Survivors often develop other serious health problems, as well.

Lyme Disease

According to the Centers for Disease Control and Prevention (CDC), there are approximately 30,000 reported cases of Lyme disease in America each year. The number of unreported cases could be significantly higher. This bacterial infection spread by ticks can be difficult to detect. Many people suffer from Lyme disease for more than a year before proper diagnosis and the condition can leave lasting effects without treatment.

Pulmonary Embolism

A pulmonary embolism is a blood clot that develops in pulmonary arteries of the lungs. It is usually the result of a blockage traveling from the deep veins of the legs or other veins in the body and can have severe, last consequences for your health. Doctors may mistake the symptoms for pneumonia or a heart attack. Identifying blood clots in the legs or other parts of the body can be useful in preventing the condition.

Multiple Sclerosis (MS)

According to the National Multiple Sclerosis Society, nearly 1 million Americans have MS. The progressive autoimmune disease destroys the protective myelin sheath around nerve fibers, impacting the central nervous system. An estimated 1 in 5 people with MS are initially misdiagnosed because doctors mistake the symptoms for another condition.

Diabetes

According to the American Diabetes Association, 34.2 million Americans have diabetes. This includes 1.6 million Americans with type 1 diabetes, a separate condition from the more common type 2 diabetes. Late-onset type 1 diabetes can result in a misdiagnosis. With numbers this high, medical mistakes are the third leading cause of death in America, causing 10 percent of fatalities nationwide. Yet despite these figures, the dangers of medical malpractice remain under-recognized.
